Official Rules
 
1. Eligibility. Subject to the additional restrictions below, the Baby Calendar Contest 2011 (the "Contest") is open to residents of Missouri who where born on or after January 1st, 2007. Children of employees of The Sedalia Democrat and any persons domiciled with, any such employees, or anyone who was a winner of the previous Baby Calendar Contest are not eligible to enter or to win.

2. Contest Period. The Contest will begin at 8:00 a.m. (C.S.T.) on Wednesday, October 6th, 2010 and end at 11:59 a.m. (C.D.T.) on Monday, November 15th, 2010. (Subjest to change based on the number of entries.)

3. How To Enter. Beginning at 8:00 a.m. (C.S.T.) Monday, Sept 20th, 2010 and ending at 12:00 p.m. (C.S.T.) Friday, Oct 8th, 2010, enter by submitting an entry form, a photo of your baby with all required information, and a requested ten dollar ($10.00) donation (cash, check, money order, credit card) to The Sedalia Democrat - NIE. Entry forms are available in The Sedalia Democrat office. Entries must be submitted by the baby’s parent’s or with their written permission. Only one photo entry per baby. Photos can be color or black/white, minimum of 3"x5" and no larger than 5"x7", originals or on CD. Digital photos in jpg format must be 300 dpi and at least 2" wide. Baby’s name, phone numbers and parent’s name must be included with all entries as well as written on the back of each photo. Poor quality photos will not be accepted. Entries with incomplete or incorrect information will not be accepted. Submitting this information, the photo and an entry form serves as a release for The Sedalia Democrat to use baby’s name and photo in The Sedalia Democrat and on its web site. All photos can be picked up at the conclusion of the contest. Copyrighted photos must be accompanied by a photographer's release. Checks and money orders should be made payable to The Sedalia Democrat - NIE.

Mail/In-Person Entry: Enter by mailing or delivering a photo of your baby, completed entry form and donation, to "Baby Calendar Contest 2011", c/o The Sedalia Democrat, 700 S Massachusetts, Sedalia, MO 65301 (office hours are 8:00 a.m. - 5:00 p.m., Monday-Friday). All mailed entries must be postmarked by Friday, Oct 1st, 2010 and received no later than Monday, Oct 4th, 2010. In person entries must be received by 12:00 p.m., Friday, Oct 1st, 2010.

Sponsor reserves the right to refuse any photograph it determines to be unacceptable. All parents specifically grant the right to The Sedalia Democrat to publish the photo of their baby in the newspaper and online at www.sedaliademcorat.com.

4. Voting Procedures and Rules. Voting for your baby begins at 8:00 a.m. (C.D.T.) on Wednesday, Oct 13th, 2010 and ends at 11:59 a.m. (C.D.T.) Monday, Nov 15th, 2010. Vote online, by mail or in-person. Voting is open to the general public who are 13 years and older. Vote by submitting an original voting ballot along with a suggested $1.00 donation to The Sedalia Democrat - NIE ($1.00 = 1 vote). There is no limit on donation amounts. You may vote without making a donation with a limit of one non-donation vote per baby per day. Voting will be conducted in rounds lasting one week with the lowest vote getters eliminated at the end of each round. Votes totals will carry over from round to round. Standings will be updated once a day and posted in The Sedalia Democrat office after 9:00 a.m. Monday through Friday.

100% of the proceeds will benefit The Sedalia Democrat NIE program. To vote online go to www.sedaliademocrat.com. Online voting will end at 11:59 a.m. (C.D.T.) on Monday, Nov 15th, 2009. When voting online, the minimum suggested donation is $10.00. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. Ad blocking software on your computer needs to be disabled so that it doesn't interfere with processing your entry. You can vote by filling out and submitting in person or by mail an original ballot. Ballots will be available in The Sedalia Democrat during the voting period, online at www.sedaliademocrat.com and at The Sedalia Democrat front desk. Ballots can be mailed to "Baby Calendar Contest 2010", c/o The Sedalia Democrat, 700 S Massachusetts, Sedalia, MO 65301, or dropped off at The Sedalia Democrat office between 8:00 a.m. and 5:00 p.m. weekdays. Mailed votes must be postmarked by Friday, Nov 12th, 2010, and received on or before Monday, Nov 15th, 2010. In person votes must be received not later than 11:59 a.m., Monday, Nov 15th, 2010. Ballots with incomplete information will be rejected.

5. The Sedalia Democrat will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible submissions (either entries, photos or ballots) or for failure to receive entries or votes due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or The Sedalia Democrat. In the event of a dispute, all online entries or votes will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of The Sedalia Democrat and none will be returned. Any questions regarding the number of entries or votes submitted or the owner of an ISP account shall be determined by The Sedalia Democrat in its sole discretion, and The Sedalia Democrat reserves the right to disqualify any entries or votes by persons determined to be tampering with or abusing any aspect of the contest.

6. Winner Selection. Winners will be determined by total number of valid votes received. The entrant with the highest number of valid votes will be the Grand Prize Winner and will be featured on the cover of the 2011 calendar. The entrants with the second highest number of valid votes thru the 12th highest will be featured in the calendar. The month that the baby will represent will be picked in order of votes, with the highest getting first choice and so on.

In the event of a tie for the Grand Prize the top two babies will both be on the cover. In the event of a tie for the 12th spot the tied babies will share the chosen month. Winners will be selected on or about Nov 16th, 2010 and will be listed in The Sedalia Democrat on Nov 17th, 2010.

All entrants will receive a calendar, and will have first option to buy them once they become available.

7. Odds. Odds of winning depend on the number of eligible entries and/or valid votes received.

8. Winner Notification and Acceptance. All winners will be notified on or about Nov 16th, 2010 at the telephone number or email address on their entry form. The Sedalia Democrat will call during regular business hours at number provided on entry form. The top twelve babies’ will have their pictures retaken by a Sedalia Democrat photographer for use in the calendar. Professional pictures will be accepted with a release from the photographer. Failure to comply with any term or condition of these Official Rules may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner's consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation.

9. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of The Sedalia Democrat. The Sedalia Democrat reserve the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as determined by The Sedalia Democrat. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of The Sedalia Democrat which corrupts or impairs the administration, security, fairness or proper operation of the contest, The Sedalia Democrat reserve the right to suspend, modify or terminate the Baby Calendar Contest 2011. Should the contest be terminated prior to the stated expiration date, The Sedalia Democrat reserves the right to award prizes based on the entries received before the termination date. Any donation made in connection with this Contest to the Sponsor is non-refundable.

10. Construction. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

11. Disclaimer. The Baby Calendar Contest 2011 is sponsored by The Sedalia Democrat Newspapers in Education program. The decisions of The Sedalia Democrat regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. The Sedalia Democrat will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest. Contest entrants agree to abide by the terms of these Official Rules and by the decisions of the contest commissioners, which are final on all matters pertaining to the contest.

This contest is not intended for gambling. If it is determined that a contestant is using the contest for gambling purposes they will be disqualified and reported to authorities.
